7. TERMINATION
Obligations and liabilities incurred before termination survive the end of this agreement. These Terms of Service remain effective until terminated by either the user or Color Culture. Users may terminate by notifying Color Culture that they no longer wish to use the services.
8. FORCE MAJEURE
Color Culture’s obligations may be suspended due to force majeure events beyond its control, such as fire, war, pandemics, or supplier delays. No compensation or reimbursement will be due in such cases.
9. PRODUCTS OR SERVICES
Certain products or services are available exclusively online and may have limited quantities. Offers are void where prohibited. Color Culture strives to display product colors and images accurately but cannot guarantee monitor accuracy.
10. ORDERING PROCESS
Users can customize and order products on the website. Payment confirmation triggers the production process, and users must review and approve the e-proof before production begins.
11. TRANSACTION & PAYMENT INFORMATION
Users must provide payment information for transactions. Color Culture uses third-party processors like Stripe for payments. Full payment is required before production begins. Overdue payments incur interest, and late payments may result in service suspension or termination.
12. LOGISTICS
Color Culture Logistics allows users to store products in a partner warehouse. Users are responsible for additional charges like storage and shipping fees. Termination requests must be submitted via email.
13. DELIVERY & RISK OF LOSS
Deliveries are typically conducted under INCOTERM DAP or DDP. Users are responsible for transportation charges and must ensure accurate delivery information. Color Culture is not liable for lost or damaged packages due to user errors.
14. TAX & TAX EXEMPTIONS
Prices exclude taxes, which are the user’s responsibility. Valid VAT numbers exempt users from taxes.
15. RETURN POLICY
Returns are accepted within 10 days of delivery for damaged, defective, or incorrectly customized products. Users must email return requests. Color Culture will verify conditions and process returns accordingly.
16. RETENTION OF TITLE
Color Culture retains ownership of goods until full payment is received. Users are liable for loss or damage after delivery.
17. THIRD-PARTY SERVICES AND WEBSITES
Color Culture is not responsible for third-party materials or websites linked on its platform.
18. ERRORS AND OMISSIONS
Color Culture is not liable for inaccuracies on its website and reserves the right to correct errors without prior notice.
19. PERSONAL INFORMATION
Personal information submitted through the website is governed by the Privacy Policy.
20. APPLICABLE LAW
These Terms of Use are governed by Texas law, with disputes resolved in Houston, Texas.
